These Terms & Conditions ("Terms") govern your access to and use of kbmediaworks.com (the "Site") and the related services offered by KB Media Works ("KB Media Works," "we," "us," or "our"), including the free 10-minute AI Revenue Audit, the contact form, and the on-site AI assistant. By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Site or request services. If you are using the Site on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. The AI Revenue Audit and other inquiries

The free 10-minute AI Revenue Audit is an introductory consultation intended to help us understand your business and discuss whether our services may be a fit. The audit is informational only and does not constitute professional advice, a guarantee of results, or a contract to provide ongoing services. Any engagement to deliver paid services will be governed by a separate written agreement.

3. Pricing and service tiers

Pricing displayed on the Site (Starter, Growth, and Dominate tiers and any associated setup fees) is provided for informational purposes and is subject to change without notice. Final pricing, scope, payment terms, and deliverables for any engagement will be set out in a written proposal or order form signed by both parties.

4. Communications and consent to be contacted

By submitting the audit form, the contact form, or by initiating a chat with the on-site AI assistant, you agree that KB Media Works may contact you at the email address and phone number you provide for the purpose of responding to your inquiry and discussing our services. Standard message and data rates may apply to any text messages. You may opt out of marketing communications at any time as described in our Privacy Policy.

5. Acceptable use

You agree not to use the Site to (a) violate any law or regulation; (b) infringe the intellectual property, privacy, or other rights of any person; (c) attempt to gain unauthorized access to any portion of the Site or its underlying systems; (d) introduce viruses, worms, or other harmful code; (e) submit false or misleading information; or (f) abuse, harass, or threaten any person or our staff. We may suspend or terminate your access for any violation of these Terms.

6. AI assistant disclosures

Responses generated by the on-site AI assistant are produced automatically and may contain inaccuracies. They do not constitute professional advice and should not be relied upon as the sole basis for any business decision. Always confirm specifics — including pricing, timelines, and deliverables — with a member of our team before acting.

7. Intellectual property

The Site, including its design, text, graphics, logos, code, and underlying technology, is owned by or licensed to KB Media Works and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Site without our prior written consent, except as expressly permitted by these Terms or applicable law.

8. Third-party links and services

The Site may include links to third-party websites or services that we do not control. We are not responsible for the content, availability, or practices of those third parties, and inclusion of a link does not imply endorsement.

9. Disclaimer of warranties

The Site and any related services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any results or revenue improvements will be achieved.

10. Limitation of liability

To the fullest extent permitted by law, KB Media Works and its owners, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or any services described on it, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or related to the Site or these Terms will not exceed one hundred U.S. dollars (US$100).

11. Indemnification

You agree to defend, indemnify, and hold harmless KB Media Works from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any rights of another party.

12. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Site will be resolved exclusively in the state or federal courts located in Ventura County, California, and you consent to the personal jurisdiction of those courts.

13. Changes to these Terms

We may revise these Terms from time to time. The most current version will always be posted on this page. Material changes will be highlighted on the Site or, where appropriate, communicated to you directly. Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms.
